Is CDL required for a Driver operating a CMV?

A Commercial Driver’s License (CDL) is required by the Department of Transportation (DOT) for individuals operating certain types of commercial motor vehicles or CMV.  The Federal Motor Carrier Safety Administration (FMCSA), part of the DOT, sets the standards and regulations for CDLs. States then issue the licenses based on federal guidelines.

DOT Standards

The DOT, through the FMCSA, establishes the minimum standards for CDLs, including requirements for knowledge and skills testing, medical qualifications, and operating a commercial motor vehicle (CMV). There are other parameters that are also checked for minimum Driver Qualification (DQ) for a CDL holder to drive on the highway or other roads.  There will be a future article posted here very soon.  If you need to know more on DQ and Driver Onboarding, please click here: www.ipsdrugtesting.com/contact-us

State-Issued Licenses

While the DOT sets the standards, it’s the individual states that issue the actual CDLs. So, to get a CDL license, a commercial driver needs to apply to the Secretary of State and fill out the application form.

What is a CMV or Commercial Motor Vehicle?

A CMV is generally defined as a vehicle used for commercial purposes, including vehicles with a gross weight rating of 26,001 pounds or more, vehicles transporting hazardous materials, or vehicles designed to carry 16 or more passengers.

CDL Requirement

If a vehicle meets the definition of a CMV and is operated on public roads, the driver needs a CDL before start driving.   A driver will need to contact the State DMV or Department of Motor Vehicles.

DOT Physical

CDL holders must also pass a DOT physical examination to ensure they meet the required health standards for driving a CMV.  DOT Physicals need to be renewed every 24 months for drivers younger than 50 years of age.  For drivers 50 to 70, the frequency is annual, and those over 70 should check with their local DMV for specific state requirements.
