A C/TPA can administer a SAP program on behalf of an employer or a driver to manage SAP (Substance Abuse Professional) process. However, a C/TPA cannot perform the actual clinical SAP evaluation; they manage the administrative steps, compliance tracking, and testing schedule. A C/TPA is a Consortium who acts as a Third Party Administrator C/TPA and is knowledgeable about how to administer a SAP pogram.
How the SAP & C/TPA Process Works
- Clinical Evaluation: You must still see a DOT-qualified SAP who will evaluate the driver, recommend education or treatment, and determine when the driver is eligible for the Return-to-Duty (RTD) test.
- Administrative Management: Your C/TPA handles the logistics by ordering the RTD test, scheduling unannounced follow-up tests, and keeping testing records compliant with the FMCSA Drug and Alcohol Clearinghouse.
- Clearinghouse Updates: Once all requirements are met, the designated C/TPA or employer will verify completion and update the Clearinghouse status from Prohibited to Not Prohibited, legally allowing the driver to get back in the truck.
Owner-Operator Exceptions
For an owner-operator, the regulations dictate that he cannot self-administer his own tests. An Owner Operator is required to enroll with a C/TPA to administer a SAP program with Return to Duty and the follow-up tests. An Owner Operator is not permitted to manage its own random selection and testing pools and must have a C/TPA to adminsiter a SAP program.
